California law determines the rate that must be charged for bail bonds. That rate is 10% and is required for all bail bond agents in the state. An 8% rate is a discount, allowed when the surety company that guarantees the bond permits it and certain state conditions are met.
How to get an 8% rate
If you have a job or a cosigner, you usually don’t need any collateral to qualify — your job is your credit. A cosigner is typically required, and both you and the cosigner will need a valid California ID and proof of current employment.
Common charges and bail amounts
A misdemeanor DUI carries penalties such as a driver’s-license suspension, fines up to $1,800 for a first offense, a possible jail sentence, and probation of three to five years. A DUI becomes a felony when you have already had three DUI offenses, have been convicted of DUI at least once before, or your actions cause an accident that injures someone else. Vehicle Code 23152 covers driving under the influence of alcohol, drugs, or a combination.

Watch the rate
California Insurance Code § 1800 caps the bail premium at 10% of the face amount of the bond — that’s the legal ceiling, not the minimum. Anything above 10% is illegal. Walk away from any bondsman who quotes above the cap, demands wired money before paperwork is signed, has no California Department of Insurance license number visible, or pressures you to decide in under a minute. A real bondsman walks the family through the math.
